Freight terms and conditions: 1. About these Terms

These freight terms and conditions (the “Terms”) govern access to and use of 3trevite.com, including its forms and chat features (the “Site”), and requests for transportation, delivery, distribution, warehousing-related movement, and related logistics services (the “Services”) offered by 9544-2463 QUÉBEC INC., operating as 3TréVite Logistics (“3TréVite,” “we,” “us,” or “our”).

These Terms apply together with any written quote, order confirmation, bill of lading, waybill, tariff, service agreement, carrier agreement, credit application, or other document issued or accepted for a shipment (each a “Service Document”). If a Service Document conflicts with these Terms, the Service Document governs that Service to the extent of the conflict. Mandatory law always prevails.

2. Acceptance and authority

By using the Site, submitting a request, accepting a quote, booking a Service, or tendering goods to us, you agree to these Terms. If you act for a business or another person, you represent that you have authority to bind them. If you do not agree, do not use the Site or book Services.

Nothing in these Terms limits rights that cannot legally be waived, including any mandatory consumer rights that apply to an eligible consumer transaction.

3. Site information and availability

Site content is general information and may change without notice. Descriptions, estimated service areas, transit times, vehicle types, and availability are not guarantees. We may suspend or restrict Site access for maintenance, security, operational, or legal reasons. You must not misuse the Site, interfere with its operation, attempt unauthorized access, introduce malicious code, scrape it at unreasonable volume, or use it unlawfully.

4. Requests are not bookings

A form submission, chat message, email, telephone conversation, or request for a quote is not a confirmed booking or contract of carriage. A Service is booked only after the steps in Section 5 are satisfied. Urgent requests remain subject to capacity, route, equipment, cargo, safety, and legal requirements.

5. Quotes and booking confirmation

A written quote is based on the information supplied by the customer, including origin, destination, dates, dimensions, weight, commodity, declared value, handling needs, access conditions, and requested service level. Unless the quote states otherwise, it remains open for 7 calendar days.

A quote becomes binding only when: (a) the customer accepts it in writing before expiry; (b) 3TréVite issues a written booking, order, or dispatch confirmation; and (c) any required deposit or prepayment has cleared. An automated receipt of a request is not confirmation. We may correct an obvious clerical or calculation error before performance begins.

Rates may be revised if the information supplied was incomplete or inaccurate, or if the customer changes the shipment, route, schedule, equipment, access, or service requirements. Additional authorized or reasonably necessary charges may include waiting time, detention, redelivery, storage, tolls, ferries, special handling, tailgate, inside delivery, white-glove service, hazardous-material handling, permits, customs-related coordination, or other items stated in the Service Documents. Waiting time is billed at $75 CAD per hour, pro-rated, after a 30-minute grace period free of charge.

6. Changes, cancellation and failed service

Requested changes are subject to written acceptance and may change the price or timing. The customer may cancel only by notifying us through the contact channel shown in the booking confirmation. Cancellations made at least 24 hours before the scheduled pickup window are free of charge. Cancellations made less than 24 hours before pickup, customer no-shows, and vehicle-ordered-not-used are subject to a fee equal to 50% of the agreed rate (minimum $150 CAD).

If pickup or delivery cannot be completed because the customer, shipper, consignee, site, goods, or information is not ready or compliant, we may charge reasonable waiting, return, redelivery, storage, or handling costs stated in the applicable Service Document.

7. Customer responsibilities and restricted goods

The customer must provide complete and accurate shipment information; lawful instructions; safe and suitable packaging; correct labels and documents; accurate weight and dimensions; and safe, timely access at pickup and delivery. The customer must disclose fragile, high-value, temperature-sensitive, regulated, dangerous, or hazardous goods before booking and comply with all applicable laws.

We may refuse goods that are unlawful, unsafe, improperly packaged, misdescribed, outside our agreed scope, or likely to harm people, property, equipment, or other cargo. Unless expressly accepted in writing, do not tender cash, negotiable instruments, precious metals or stones, live animals, human remains, illegal goods, weapons, explosives, or goods requiring controls we did not agree to provide.

For cross-border Services, the customer remains responsible for customs documents, importer/exporter obligations, duties, taxes, brokerage, and clearance unless a Service Document expressly says otherwise.

8. Payment Terms

Payment terms

Currency and taxes. All quotes, deposits, invoices, fees, and payments are in Canadian dollars (CAD) unless the applicable written quote expressly states otherwise. Applicable taxes are extra unless expressly included.

Accepted methods. We accept Interac e-transfer, electronic funds transfer (EFT / direct deposit), and business cheque. A $45 fee applies to any NSF cheque or failed or returned electronic payment, plus any bank charges we incur, to the extent permitted by law.

When payment is due. Unless a written Service Document states different approved terms, payment is due Net 15 from the invoice date. The customer must pay undisputed amounts without set-off, deduction, or withholding except where required by law.

Deposits and credit approval. For larger, special, high-value, cross-border, or capacity-reserved jobs, we may require a deposit of 50% when the quoted value exceeds $2,000 CAD, or another amount stated in the quote. A booking is not confirmed until the deposit clears. Deposits are applied to the final invoice. If we cancel, the deposit is refunded in full. If the customer cancels less than 24 hours before the scheduled pickup or does not show, the deposit is applied to the cancellation charges described above. Credit terms are subject to approval and may be reduced, suspended, or withdrawn for late payment or increased risk.

Late payment, invoice disputes and chargebacks

Late payment. Overdue amounts bear interest at 2% per month (24% per year), calculated from the due date until paid, or the maximum lawful rate if lower. We may also charge a $45 late-payment administration fee per overdue invoice where lawful, suspend Services, require prepayment, and recover reasonable collection costs to the extent permitted by law.

Invoice disputes. The customer must give written notice of a good-faith invoice dispute within 15 calendar days after the invoice date, identifying the invoice, disputed amount, and reasons with supporting documents. Undisputed amounts remain due on time. The parties will work promptly and in good faith to resolve the dispute.

Chargebacks and reversals. Before requesting a payment reversal or chargeback, the customer must contact us and allow a reasonable opportunity to investigate, unless prohibited by law or card-network rules. We may contest an improper chargeback and recover the unpaid amount and reasonable resulting costs where legally permitted.

Application of payments. We may apply payments to the oldest outstanding undisputed invoice first, unless the customer identifies another invoice and we accept that allocation in writing.

9. Pickup, transit and delivery

Pickup and delivery times are estimates unless a Service Document guarantees otherwise in writing. The customer must ensure safe access, suitable loading areas, and authorized persons present at pickup and delivery. If nobody is available, access is unsafe, or the site cannot receive the goods, we may return, store, or redeliver the shipment and charge reasonable resulting costs.

Proof of delivery may include a signature, photo, timestamp, or electronic confirmation. The customer should inspect goods at delivery and note any visible loss or damage on the delivery record before signing.

10. Cargo liability and claims

Our liability for loss of or damage to goods is limited as stated in the applicable bill of lading or Service Document, and otherwise to the maximum permitted by applicable transportation law. We are not liable for loss or damage caused by the customer’s acts or omissions, inherent vice of the goods, insufficient or defective packaging, or force majeure.

Visible loss or damage must be noted on the delivery record at the time of delivery. Concealed loss or damage must be reported in writing within 48 hours of delivery. Formal cargo claims must be submitted in writing within 30 calendar days of delivery (or of the scheduled delivery date for lost shipments), with supporting documents including the bill of lading, invoice, photos, and proof of value. We may inspect damaged goods before disposal or repair.

Our total liability for any shipment will not exceed the lesser of the declared value stated in the Service Document or the applicable statutory limit, and in no event will we be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profit, revenue, or business opportunity.

11. Insurance

We maintain the insurance coverage required by law for our operations. Additional or declared-value coverage may be available on request before booking and may affect the rate. Insurance does not replace proper packaging and disclosure obligations under Section 7.

12. Subcontractors

We may use qualified subcontractors, owner-operators, or partner carriers to perform Services. We remain responsible to the customer for performance under these Terms, subject to the limitations stated here.

13. Force majeure

Neither party is liable for delay or failure caused by events beyond reasonable control, including severe weather, natural disasters, road closures, accidents, labour disruptions, pandemics, government actions, or utility or communications failures. We will notify the customer promptly and resume performance as soon as practicable.

14. Limitation of liability

To the maximum extent permitted by law and except for cargo claims governed by Section 10, our total liability arising from or related to the Services or the Site will not exceed the amounts paid by the customer for the specific Service giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages.

15. Indemnity

The customer will indemnify and hold us harmless from claims, losses, damages, and reasonable costs arising from the customer’s breach of these Terms, inaccurate information or instructions, improper packaging, undisclosed hazardous or regulated goods, or the customer’s violation of law.

16. Privacy

Personal information submitted through the Site is handled in accordance with our Privacy Policy and applicable privacy law. By using the Site you consent to that handling.

17. Intellectual property

The Site and its content, including text, graphics, logos, and software, are owned by or licensed to us and protected by law. You may not copy, reproduce, distribute, or create derivative works from Site content without our written permission.

18. Governing law and disputes

These Terms are governed by the laws of Québec and the laws of Canada applicable there. Any dispute will be submitted to the competent courts of the judicial district of Montréal, Québec, unless the parties agree otherwise in writing.

19. Language

These Terms are provided in English and French. Both versions are intended to express the same business terms; in case of conflict, the French version prevails, subject to mandatory law.

20. Changes to these Terms

We may update these Terms from time to time. The version in effect at the time of booking or Site use applies to that transaction. Material changes will be posted on this page with a revised effective date.
